US Copyright Office Releases Report on Copyright and Artificial Intelligence (AI)

        As countries around the world have been accelerating their researches on the protection of AI-related innovations, the recent release of Deepseek has drawn more global attention on the rapid development of Artificial Intelligence (AI).

        In 2023, the US Copyright Office officially proposed an initiative to continue discussing copyright legal and policy issues arising from AI, including the scope of copyright protection for AI-generated works and related issues regarding the use of copyrighted materials in AI training. To this end, the US Copyright Office organized a series of public hearings and seminars, extensively collected public opinions, and carefully compiled the "Copyright and Artificial Intelligence Report".

        According to the official introduction, this Report is divided into three parts. Part 1, published in July 2024, mainly focuses on the topic of digital replicas. The recently released Part 2 delves into the copyrightability of outputs created using generative AI. The yet-to-come Part 3 will focus on addressing the legal implications of training AI models on copyrighted works, licensing considerations, and the allocation of any potential liability.
